Acceptable Use Policy
Lawyer-review draft — last updated 28 August 2026.
This Policy forms part of the Merchant Terms. A merchant must not use, enable, direct or help another person use Upsell Me to:
- sell, advertise or facilitate unlawful, prohibited, counterfeit, unsafe, sanctioned or rights-infringing products or conduct;
- mislead customers about price, discount, scarcity, reviews, consent, shipping, recurring charges, fulfilment, tax, duties, refunds or the identity of the seller;
- create dark patterns, fake urgency, false savings, involuntary additions or an offer that is unlawful under consumer, advertising, accessibility or privacy law;
- collect or expose card data, passwords, authentication secrets, sensitive personal data or data not reasonably required for the configured feature;
- circumvent Shopify, payment, consent, eligibility, idempotency, tenant, rate, fulfilment, discount, inventory or other safeguards;
- access another merchant's or customer's data, impersonate another person, test without authority, probe vulnerabilities, introduce malware, scrape, overload, reverse engineer or interfere with the service;
- use analytics or attribution as conclusive proof when Shopify records show otherwise, or fabricate events, orders, usage or billing evidence;
- violate Shopify's terms, platform rules, protected-customer-data requirements, applicable law or third-party rights.
Enforcement
Marvello may investigate and proportionately restrict or suspend affected functionality where reasonably necessary to protect customers, merchants, the service or Shopify. Where practical, Marvello will explain the reason and allow remediation. Serious, repeated or unlawful misuse may result in termination and reporting where law requires it.
